These Terms of Service ("Terms") govern your use of heartofthesea.online and your booking of a charter through Heart of the Sea ("Heart of the Sea," "we," "us," or "our"). By submitting a booking inquiry or using our site, you agree to these Terms.

1. Our Service — Bareboat Vessel Charter

Heart of the Sea arranges bareboat charters: we make a vessel available to you for a specified charter period. As the charterer, you have the right — and responsibility — to select and hire your own qualified captain and crew, separately from the vessel charter fee. For your convenience, we can provide a list of independent, qualified professionals to choose from, but any captain or crew you select is engaged directly by you, not employed by Heart of the Sea.

Heart of the Sea acts as a booking intermediary connecting charterers with available vessels; we are not the operator of the vessel and are not responsible for the acts or omissions of independently contracted captains or crew.

2. Booking & Quotes

• Pricing shown on our site is a starting rate and may vary based on date, duration, season, and vessel availability. All bookings are subject to a personalized quote confirmed via WhatsApp or email.
• A booking is only confirmed once we have received your signed acknowledgment and required deposit through the secure payment link we provide.
• Vessel charter fees and independent captain/crew fees are quoted and paid separately.

3. Payments & Deposits

A deposit is required to secure your charter date. The remaining balance is due according to the schedule communicated at the time of booking. Accepted payment methods will be confirmed by your booking agent.

4. Cancellations & Changes

Cancellation terms (including any applicable refund or rescheduling policy) will be confirmed in writing at the time of booking, as they may vary by vessel and season. Charters may be rescheduled at no additional cost due to unsafe weather conditions, at the discretion of the captain, subject to availability.

5. Guest Capacity & Conduct

• Each vessel has a maximum legal passenger capacity, which will be confirmed for your specific vessel at the time of booking; do not exceed the confirmed capacity.
• Guests are expected to follow the reasonable safety instructions of the captain at all times. The captain has final authority over the safe operation of the vessel and may end a charter early in the interest of safety.
• Illegal activity, harassment, or conduct that endangers other guests or crew is prohibited and may result in early termination of the charter without refund.

6. Assumption of Risk

Boating and water-based activities carry inherent risks. By booking a charter, you acknowledge these risks and agree to follow all safety guidance provided by the captain and crew. Guests are responsible for their own safety and the safety of their invitees, including appropriate supervision of minors.

7. Add-On Services

Optional add-ons (chef, catering, DJ, photography, decorations, water toys, etc.) are arranged as a convenience and may be provided by independent third-party vendors. Availability, pricing, and quality of these services are subject to the terms of the respective vendor.

8. Limitation of Liability

To the fullest extent permitted by law, Heart of the Sea's liability for any claim arising from your use of our booking service is limited to the amount of fees paid to Heart of the Sea directly. We are not liable for the independent acts of captains, crew, or third-party vendors engaged separately by the charterer.

9. Intellectual Property

All content on heartofthesea.online, including text, photos, and branding, is the property of Heart of the Sea or its licensors and may not be copied or reused without permission.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, and any disputes will be resolved in the courts located in Miami-Dade County, Florida.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of our site or services after changes take effect constitutes acceptance of the updated Terms.
